General conditions of sale and use of the site
1. OBJECT
The company TELEMAQUE provides a sales service at distance of personalised astrological studies, consultation online of the categories astrology, tarot, numerology and divination arts, (hereafter collectively called «Products»), accessible at the URL address http://www.easyhoroscope.com, (hereafter called the «Website»).
The order online of TELEMAQUE Products implies the unreserved acceptance by the client (hereafter called the «Client») of the present general conditions (hereafter called the «General Conditions»), of which they have previously had the opportunity to read in their entirety.
Certain conditions may be added to these General Sales Conditions. The Client will be informed of any such existing through the Website before any transaction has been completed.
Clairvoyance consultation services by telephone which are present and distinct on this site from Audiotel are not operated by the TELEMAQUE Company.

2. OPENING OF A MEMBERS ACCOUNT
Before any purchases of Products, the visitor should proceed with their registration on the Website. The registration procedure is according to the terms and conditions described as follows.
- Contractual Capacity: To register on the Website, the visitor should be legally entitled to undertake a contract, that is to say be over 18 years of age, sound of mind, or be legally independent if a minor.
- Acceptance of the General Conditions: The visitor cannot become a member or Client unless they have agreed to accept the General Conditions by ticking the box provided and after providing their personal contact details.
- Provision of Personal Contact details: The visitor is required to provide certain personal information (first name, last name, email address, etc...).
The information that the Client provides through the Website enable TELEMAQUE to prepare and fulfill their orders.
In accordance with article 32 of the Law concerning Information and Freedom of the 6 January 1978, the information required by TELEMAQUE in order to prepare and fulfill the orders are distinguished by an asterisk on the pages of the Website.
Other information requested, for which the reply is purely optional, are destined to increase knowledge about the Client so enabling TELEMAQUE to improve the Products and services available to them.
The treatment of this personal information is undertaken by TELEMAQUE, who undertake the level of protection necessary with respect to the information provided to ensure respect for the Client's private life and freedom of fundamental rights.
The Client is informed that their financial data will be kept securely, filed, for a duration of 14 months following the date of the bank card debit in order to protect against payment fraud.
The financial data is encrypted and and rigorous security measures are taken in this respect.
In accordance with the law concerning Information and Freedom, the Client has the right to access, modify and delete data concerning them (articles 38 to 40 of the Information and Freedom Law of 6 January 1978). The Client cannot object to the treatment of data for legitimate reasons. The Client may exercise their rights by addressing a letter to the person responsible for data treatment, Mr Hervé PARSONS, to TELEMAQUE, 80 route des Lucioles, Les Espaces de Sophia, Bâtiment A, 06560 VALBONNE .
Unless express opposition is received from the Client, TELEMAQUE and their partners may notify the Client by email and/or by letter and/or by telephone of Products and services, advertising messages and information on Products and services offered by TELEMAQUE and their partners.
- Choice of Password: When registering, each Client is required to choose a user name and a password and should supply their email address. To identify themselves on the Website, the Client should supply their email address and their password.
- The password is personal and confidential.
- Each Client is solely responsible for the use and conservation of their personal password.
- Each Client agrees to do everything reasonably possible to keep their password secret and divulge it to no-one.
- All loss or involuntary divulgence of an element susceptible to enabling a third party to obtain knowledge of a Client's password should be immediately notified in writing to the company TELEMAQUE so they may proceed with changing the password.
- Guarantee relative to information supplied: Each member guarantees the truth and exactitude of information they supply.
3. LAW APPLICABLE
The parties agree that the contract concluded the Client is in accordance with French Law.
4. PAYMENT OF PRODUCTS IN ZODIACS
The payment of Products is in dollars as forfeit for damages sustained.
5. STAGES OF THE ORDER
The process of ordering online will comprise at least the following stages:
- The Client selects the Product of their choice.
- A description of the Product and its price is shown.
- The Client proceeds with the payment.
- After the payment has been completed, the Client can access the Product.
6. CONTENT DIFFUSED ON THE WEBSITE BY THE CLIENT
- Type of content forbidden: It is forbidden to the Clients to diffuse on the Website, in any manner, any messages, comments or other content:
- Susceptible to infringing upon the human dignity of a person.
- Of an injurious or defamatory nature.
- Of a pornographic or pedophile nature.
- Apologising for crimes against humanity.
- Inciting the committal of crimes or delinquency.
- Inciting racial hatred or discrimination.
- Susceptible of infringing upon the private life or photographic rights of any person.
- Susceptible of infringing upon intellectual property rights or those of a third party.
- Susceptible of infringing upon the rights of database producers.
- Constituting misleading or comparative advertising.
- Publicising tobacco, alcohol or drugs.
- Containing a virus or any other programme susceptible of damaging , destroying or altering the systems, programmes, information files or data etc of the company TELEMAQUE.
- In a general manner, anything illicit.
- Rights of moderation by the TELEMAQUE company: The company TELEMAQUE holds the right to delete any content diffused on the Website by the Client that presents any of the previously mentioned characteristics.
- Consequences of the diffusion of forbidden content: In the case of diffusion by the Client of the forbidden content o the Website, the Client's account will be deleted .
7. FORCE MAJEURE
TELEMAQUE declines all responsibility for whatever lack in their contractual obligations in the hypothesis of a Force Majeure or unlucky instance, including, but not limited to, war, catastrophes, fires, internal or external strikes, faults or breakdowns (internal or external), and in a general manner any event that inhibits the correct execution of orders.
TELEMAQUE will not be held responsible for any problems that may arise during the secure transactions. This responsibility lies with the organisations responsible for these services.
8. RIGHTS OF RETRACTION
In accordance with article L.121-20-2 of the Consumer Code, the Client is informed that the right of retraction cannot be exercised for the contracting of the provision of services of which the provision has started before the end of a clear seven day delay.
For services that have not been supplied withing the delay period mentioned, the Client has a complete seven day period in which they may exercise their right to retraction relative to the purchase of products, without having to justify their motives or pay any penalties. The seven day delay starts at the conclusion of the purchase contract of products. When a seven day delay expires on a Saturday, Sunday or Bank Holiday it is prolonged to the first working day that follows.
9. PROTECTION OF INTELLECTUAL PROPERTY RIGHTS
All content of the Website and all intellectual property rights of ownership or relative are the property of TELEMAQUE and, as appropriate, to the company editing the site. It is not conceded that the Client has any rights to the content or intellectual property rights of the Website.
Any placing of textual hyperlinks pointing to the Website will be subject to a previous written agreement with TELEMAQUE.
Any non-authorised exploitation of all or part of the Website contents and intellectual property or relative may be subject to judicial pursuit.
10. USE OF THE WEBSITE
TELEMAQUE is not responsible if the Clint is unable to access the Website, notably for reasons of maintenance operations or if access is interrupted, at whatever time, or if there is a fault, independent of their wishes, that impedes the realisation of an operation.
TELEMAQUE does not guarantee that the Website will be exempt from computer viruses or other anomalies independent of their wishes or abilities.
11. COOKIE INSTALLATION
Definition of a cookie: Information relative to the navigation of a visitor.
TELEMAQUE wishes to implant a cookie in their Clients computers. A cookie does not permit TELEMAQUE to identify the client; however, it registers information relative to the navigation of the Client's computer on the Website (the pages that the Client has visited, the date and time of visits, etc...) that TELEMAQUE may read on the Client's future visits.
The duration of the conservation of the information in the Client's computer is 10 years. TELEMAQUE hereby informs the Client that they may block the addition of cookies by configuring their navigator accordingly. If the Client modifies the setup of their navigator to block cookies they will not be able to make any purchases on the Website.
